Before you and your family enter the wonderful world of stories, please take a moment and read these Terms and Conditions ("Agreement") carefully. They are important since they govern the relationship between yourself and Beijing Baigu Technology Co., Ltd. - and as such affect your legal rights and obligations.

1. Description of Service

Beijing Baigu Technology Co., Ltd. (hereinafter "Company", "us", "our" or "we") offers a digital content service designed for children and families, with personalized features and functionalities (the "Service") that allow our users (hereinafter "you") to access a library of children's audio stories, create original stories using artificial intelligence, and utilize other content (the "Content").

By accessing, downloading, installing, or using the Service, you signify that you have read, understood, and agree to be bound by this Agreement. If you are a parent or guardian and you provide consent for your child to use the Service, you agree to be bound by this Agreement in respect of your child's use of the Service. If you do not agree to these terms, you may not use the Service.

2. Age Limit and Account Eligibility

2.1. Eligibility for Parents/Guardians

To create an account and enter into this Agreement, you must be at least eighteen (18) years old, or the age of legal majority in your jurisdiction, and capable of entering into a binding contract.

2.2. Children's Use

Children under the age of 13 (or the relevant age of consent in their jurisdiction) may only use the Service under the direct supervision and with the explicit consent of a parent or legal guardian. The parent or guardian is responsible for the child's activity on the Service and for ensuring the child's compliance with this Agreement.

2.3. Account Information

To access the Service, you need an active account. You agree to provide accurate, current, and complete information during the registration process and to update such information to keep it accurate, current, and complete.

2.4. Account Security

You are responsible for safeguarding your account password and for any activities or actions under your account. You agree to notify us immediately of any unauthorized use of your account.

3. License to Use the Service

Subject to your compliance with this Agreement, Company grants you a limited, non-exclusive, non-transferable, non-sublicensable, revocable license to download, install, and use the Service on a compatible device that you own or control, solely for your personal, non-commercial entertainment purposes.

4. Fees and Payment

Certain features of the Service may be offered on a subscription basis ("Plan(s)") or for a one-time fee. Our subscription fees are displayed on our website and/or App.

We may change a subscription fee due to various factors, including, for example, inflation or Service improvements. If the fee is changed, we will notify you at least 30 days in advance, giving you enough time to cancel your subscription before the change takes effect.

All fees are non-refundable except as required by law or as otherwise stated by us.

5. User Conduct and Responsibilities

The Service is for personal, non-commercial use as per this Agreement. You and anyone using your account (including any child under your supervision) must not:

• Use the Service for any illegal, harmful, or fraudulent purpose;
• Create, upload, or share any content that is unlawful, defamatory, obscene, abusive, invasive of privacy, or otherwise objectionable;
• Use the AI story creation tools to generate content that is inappropriate for children, hateful, discriminatory, or infringing on intellectual property rights;
• Use the voice cloning feature with any voice other than your own, or your child's voice for whom you are the legal guardian and have obtained their consent (if applicable by age), or any other individual's voice without their explicit, verifiable consent. Misrepresenting identity or creating "deepfakes" for malicious purposes is strictly prohibited;
• Engage in fraudulent or illegal activities;
• Disrupt the Service or cause harm to Company, its affiliates, or third parties;
• Engage in abnormal usage patterns that clearly deviate from reasonable use, including excessive consumption or generation of Content;
• Exploit for any purpose (commercial or otherwise), copy, modify, adapt, create derivative works of, display, distribute, or circulate any material, Content, or part of the Service, except as expressly permitted;

6. Intellectual Property Rights

6.1. Our Content

The Service and all materials therein, including, without limitation, pre-existing stories, software, images, text, graphics, logos, patents, trademarks, copyrights, audio, and the "look and feel" of the Service, and all Intellectual Property Rights related thereto ("Company Content"), are the exclusive property of Company and its licensors.

6.2. User-Generated Content

AI-Generated Stories: You may use our AI tools to generate stories. You retain any intellectual property rights you may have in the original prompts or ideas you input. Company grants you a license to use the AI-Generated Stories created through your account for personal, non-commercial purposes within the Service. Company retains all rights to the underlying AI models and algorithms.

7. Suspension and Termination

You may terminate this Agreement at any time by discontinuing your use of the Service and deleting your account.

We may suspend or terminate your access to the Service at any time, with or without cause or notice, effective immediately, if we believe, in our sole discretion, that you have violated this Agreement.

8. Disclaimers

THE SERVICE IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS. TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, COMPANY, ITS AFFILIATES, AND ITS LICENSORS DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO, IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT.

9. Limitation of Liability

TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL COMPANY, ITS AFFILIATES, DIRECTORS, OR EMPLOYEES BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING OUT OF OR RELATING TO YOUR ACCESS TO OR USE OF, OR INABILITY TO ACCESS OR USE, THE SERVICE.

10. Indemnification

You agree to defend, indemnify, and hold harmless Company and its affiliates, licensors, and their respective officers, directors, and employees from and against any claims, liabilities, damages, and costs arising out of or relating to your violation of this Agreement or your use of the Service.

11. Modifications to the Agreement

We reserve the right, at our sole discretion, to modify or replace this Agreement at any time. If a revision is material, we will provide at least 30 days' notice prior to any new terms taking effect.

12. Governing Law and Dispute Resolution

This Agreement and any dispute arising out of or related to it shall be governed by and construed in accordance with the laws of the People's Republic of China, without regard to its conflict of law principles.

Any dispute, controversy, difference, or claim arising out of or relating to this Agreement shall be referred to and finally resolved by arbitration administered by the China International Economic and Trade Arbitration Commission (CIETAC) under the CIETAC Arbitration Rules in effect when the Notice of Arbitration is submitted. The seat of arbitration shall be Beijing. The language of arbitration shall be English.

13. General Terms

This Agreement, together with the Privacy Policy, constitutes the entire agreement between you and Company regarding the Service.
